Terms of Service
These Terms of Service ("Terms") are a legally binding agreement between you and Urban Firearm Society LLC ("Company," "we," "us," or "our"), a Massachusetts limited liability company based in Boston, Massachusetts.
These Terms govern your access to and use of www.urbanfirearmsociety.com (the "Website"), the student portal at my.urbanfirearmsociety.com (the "Portal"), and our firearms training and related educational classes and services (together with the Website and Portal, the "Services").
By accessing or using the Services, registering for a class, or creating a Portal account, you agree to these Terms. If you do not agree, do not use the Services.
Eligibility and Requirements
Age Requirements
- Students must be at least 14 years of age to enroll in our courses.
- Students under 18 require parental or legal guardian permission. A parent or legal guardian must complete registration and payment and must be present at the beginning of class to provide consent and complete required documentation.
- Portal accounts are available only to adults. Minors are not issued Portal accounts.
- Participants under 21 may have additional restrictions based on course content and applicable law.
We reserve the right to deny entry to any minor who arrives without a parent or guardian present to complete the necessary documentation.
Legal Requirements
- You must not be legally prohibited from possessing or handling firearms under applicable federal, state, and local law.
- You may be required to present government-issued photo identification. We may scan or photograph your ID and record identity information (such as name, date of birth, and address) for verification and class records, as described in our Privacy Policy.
- Providing false identification or refusing required identity verification may result in denial of entry or removal from class without refund, subject to our Class Policies.
Physical and Mental Fitness
- You must be physically and mentally capable of safely handling firearms and participating in the applicable course activities.
- You must disclose any medical conditions that may affect your ability to safely participate.
- We reserve the right to refuse service or remove you from a class if we determine you cannot safely participate.
Student Portal Accounts
Eligible adult students may access the Portal using email one-time-passcode authentication. You are responsible for maintaining the security of your email account and for activity that occurs under your Portal account. You may upload a profile picture and use Portal features such as viewing class-related information, certificates (when available), profile settings, and community chat.
We may suspend or terminate Portal access if you violate these Terms, misuse the Portal, or if we discontinue Portal features. You may request account deletion or deactivation as described in our Privacy Policy; registration and class records may be retained as stated there.
In-Person Waivers and Assumption of Risk
Firearms training involves inherent risks, including serious injury or death. Before or during class, you (or a parent/guardian for a minor) may be required to sign a separate liability waiver and related consent forms. These Terms do not replace that in-person waiver. If there is a conflict between these Terms and a signed in-person waiver regarding liability for in-person training, the signed waiver controls for that subject matter to the extent permitted by law.
By participating in our Services, you acknowledge the risks of firearms training and agree to follow all instructor directions, range or classroom safety rules, and applicable laws.
Conduct and Safety
You agree to behave in a safe, respectful, and lawful manner while using the Services and attending classes. We may refuse admission, remove you from a class, or deny future Services if you violate safety rules, these Terms, Class Policies, or applicable law, or if we reasonably believe your participation creates a safety risk. Refusal or removal under this section may be without refund, as described in our Class Policies.
Photography and Recording
We may occasionally photograph or record classes. We ask for consent before using your likeness for marketing. Declining marketing photo/video consent does not by itself prevent class attendance.
Accuracy of Information; No Legal Advice
We strive to provide accurate and up-to-date information on the Website and in our Services. However, we do not guarantee the accuracy, completeness, or reliability of any information on the Site or in the Services. The Website may include historical and legal reference material, including our gun-law reference content. That material is for general informational purposes only and is not legal advice. It is not a substitute for advice from a licensed attorney or for consulting official government sources. Laws change, and information may become outdated. Any reliance on Website materials is at your own risk. You are responsible for monitoring changes to our Site and for verifying information that matters to your situation.
Intellectual Property
The Website, Portal, course materials, branding, and related content are owned by Company or its licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to access and use the Services for your personal, non-commercial use in connection with registering for and attending our classes. You may not copy, distribute, modify, or create derivative works from our materials except as expressly permitted by us in writing.
Cancellation and Refund Policy
All cancellations, refunds, and rescheduling are governed by our Refund and Cancellation Policy (Class Policies), which is incorporated into these Terms by reference and available here.
Privacy Policy
Our collection and use of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.
Payments
Class payments are processed by Stripe. By registering, you authorize us and Stripe to charge the payment method you provide for the applicable fees. Billing details and payment data are handled as described in our Privacy Policy and Stripe's terms and privacy policy.
Limited Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, COMPANY'S LIABILITY TO YOU IS LIMITED. IN NO EVENT SHALL COMPANY BE LIABLE FOR DAMAGES OF ANY KIND (INCLUDING, BUT NOT LIMITED TO, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, LOST PROFITS, OR LOST DATA, REGARDLESS OF THE FORESEEABILITY OF THOSE DAMAGES) ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE, PORTAL, OR ANY OTHER MATERIALS OR SERVICES PROVIDED TO YOU BY COMPANY. This limitation applies regardless of whether the damages arise out of breach of contract, tort, or any other legal theory or form of action. Some jurisdictions do not allow certain limitations of liability; in those jurisdictions, our liability is limited to the fullest extent permitted by law.
Prohibited Uses
You may not misuse the Website, Portal, or Services. Without limitation, you must not: (a) access content or data not intended for you, or accounts you are not authorized to use; (b) probe, scan, or test the vulnerability of our systems without authorization; (c) interfere with service to any user, host, or network (including via malware, flooding, or similar attacks); (d) use the Services to send unsolicited commercial email; (e) forge headers or otherwise disguise the origin of communications; or (f) reverse-engineer or attempt to extract source code from the Services except where applicable law prohibits this restriction. Violations may result in civil or criminal liability and termination of access.
Indemnity
You agree to indemnify, defend, and hold harmless Company and its affiliates, officers, directors, employees, consultants, agents, and representatives from and against any third-party claims, losses, liability, damages, and costs (including reasonable attorneys' fees) arising from your access to or use of the Services, your violation of these Terms, or your infringement of any intellectual property or other right of any person or entity.
Severability
If a court of competent jurisdiction finds any provision of these Terms unenforceable, the remaining provisions remain in full force and effect. No waiver of any breach is a waiver of any other breach, and any waiver must be in writing and signed by an authorized representative of the waiving party.
Governing Law
These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law principles. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in the Commonwealth of Massachusetts, and you consent to personal jurisdiction in those courts.
Changes to Terms
We may update these Terms by posting a revised version on this page. The "Last Updated" date will change when we do. It is your responsibility to review these Terms periodically. Your continued use of the Services after changes are posted constitutes acceptance of the updated Terms.
